Trusts Issues in Family Law

Members advise and are briefed to appear in court (often led by family silks) in connection with ancillary relief provision ordered from and against trusts and trustees resident both within the jurisdiction and overseas. Members are instructed by those attacking such trusts, those defending them, and the trustees themselves.

Typical work in this area includes:

  • the nature and extent of beneficial interests
  • the powers and obligations of trustees
  • allegations of sham
  • enforcement
  • jurisdictional issues
  • international taxation of trusts
